According to reports, Drake and Chris Brown are disputing copyright infringement accusations concerning their 2019 hit song “No Guidance,” claiming the lawsuit is ‘baseless.’
According to Billboard, Drizzy and Breezy have also asked that a federal judge dismiss the lawsuit, which was filed in October by Brandon Cooper and Timothy Valentine asserting that the pair stole their 2016 song “I Love Your Dress” to produce “No Guidance.”
Per Drake and Brown’s lawyer, James G. Sammataro, the hook “you got it,” which is included as part of the lines plagiarized by the artists is far too common to fall under the purview of copyright law.
Sammataro stated, “Plaintiffs’ suit is premised upon the alleged similarity [to a] wholly generic lyrical phrase. No one, including plaintiffs, can own or monopolize the non-copyrightable phrase ‘you got it,’ and it should come as no surprise that this phrase appears in countless other works.”
Cooper and Valentine’s complaint in October noted a number of additional similarities between the songs, claiming that Drake and Brown’s song “was copied” or “derived” from “the beat, lyrics, hook, rhythmic structure, metrical placement, and narrative context” of “I Love Your Dress.”
Sammataro stated in response to their claims, “The Court can hear for itself that the total concept and feel of the songs is vastly different,” he wrote. “Plaintiffs’ song is a slow, R&B love ballad about the writer’s wife featuring one vocalist and relatively few lyrics. In sharp contrast, ‘No Guidance’ is a faster, longer, and sexually explicit rap and R&B song about a new romantic interest.”
Furthermore, Sammataro stated that Cooper and Valentine were unable to establish that Brown and Drake heard their track, which is required in a copyright infringement suit, and that the claim is based on “speculative allegations.”
Chris Brown’s “No Guidance,” which features Drake, was released in June 2019 on his Indigo album. The song reached No. 5 on the Billboard Hot 100 in October 2019 and was subsequently nominated for a Grammy for Best R&B Song.
